California Department Public Health is Hiring an Attorney III Near California, CA

The California Department of Public Health (CDPH) is currently hiring for an Attorney III within our Office of Legal Services (OLS).

OLS provides comprehensive legal support and services to CDPH programs and leadership to advance CDPH’s mission to optimize the health and safety of all Californians and is comprised of four legal teams: the Operations and Administrative Litigation (OPAL) team; the Center for Health Care Quality (CHCQ) team; the Public Health Programs (PHP) team; and the Regulations, Privacy, and Special Projects team.

This position is for the CHCQ team and will work primarily with CHCQ’s Licensing and Certification (L&C) Program, who is responsible for ensuring that health care facilities and certain health professionals are licensed, regulated, inspected, and/or certified to operate in California.

We are looking for someone that has an interest in, or experience with, litigation; licensing and enforcement schemes; and modalities for the delivery of care, as well as an understanding of public health principles and practices.

Responsibilities:

  • Serve as a key legal advisor to one or more district offices and/or programs within CHCQ on complex legal issues that arise and are specific to the district or program, such as issues related to the licensure and certification of facilities CHCQ regulates, and medical breaches
  • Analyze, interpret, and apply state and federal laws regarding various types of facility applications and/or issues and provides verbal and written advice to the programs within CHCQ; review contracts, notices, bill analyses, regulations, decision memorandum, and other documents; draft complex legal opinions; and present legal opinions/recommendations clearly and logically in both verbal and written form
  • Provide oral and written legal analysis to key decision makers within and outside of the CDPH, including executive staff within CHCQ, the OLS Chief Counsel, the Director of CDPH, and/or the California Health & Human Services Agency executives, on complex and politically sensitive areas of the law pertaining to CHCQ
  • Provide litigation support to the Attorney General’s Office in matters pertaining to the CDPH, which includes, but is not limited to, legal correspondence, negotiation, and developing strategies and tactics with the assigned Deputy Attorney General

Desirable Qualifications:

  • Minimum of five (5) years of legal experience
  • An interest in, or experience with, litigation; licensing and enforcement schemes; and modalities for the delivery of care
  • An understanding of public health principles and practices
  • Excellent analytical, research, and communication skills (both verbal and written)
  • Demonstrated ability to prioritize workload and manage multiple projects with short-term deadlines
  • Experience drafting and/or interpreting and applying statutes and regulations
  • Knowledge of relevant state and federal privacy laws; the Public Records Act; and California state administrative law, particularly the Administrative Procedure Act
